State subsidies

Regulations relating to state subsidies are becoming increasingly important. The public authorities provide financial support to businesses through a variety of schemes. At the same time, the rules on state subsidies establish constraints for publicly owned business activity and agreements between private enterprises and the public sector.

At the same time, the rules on state subsidies establish constraints for publicly owned business activity and agreements between private enterprises and the public sector.

The rules on state subsidies are relevant in connection with both support schemes whose lawfulness depends on them being reported to the ESA in Brussels, and with many transactions involving public funds.

With some of our lawyers having previously worked at the ESA, Hjort has both extensive expertise and practical experience with regard to state subsidies and other types of publicly funded business support schemes. Our services include:

  • Assessing and handling matters relating to state subsidies, on behalf of both public and private enterprises, to ensure that unintentional support is not given and that any support provided is lawful.
  • Reporting to the ESA to obtain approval for support schemes and/or clarify whether they fall within the state subsidy regulations.
  • Complaints to the ESA and petitions to national courts for enforcement of state support rules.
